The use of Avail Media's marks in any advertisement, promotional literature, documentation, and/or other marketing materials shall be subject to Avail Media's prior review and written approval, which shall not be unreasonably withheld or delayed following receipt of an advance copy of each such advertisement, etc. The entity utilizing Avail Media's logo shall not adopt brands, logos, trademarks, trade names, or other marks which are the same as or confusingly similar to the Avail Media marks. In no event, and under no circumstances, shall Avail Media's marks be used in any manner that is derogatory, negative, likely to confuse a third party as to source of goods or services, or otherwise injurious to Avail Media, as determined by Avail Media in its sole discretion.
